
Fred Caterson Champions Inc (FCC) are over the moon after the Court of Appeal ruled in our favour to allow us to present expert evidence concerning the Powerful Owls to a full hearing of the Land and Environment Court in our case against The Hills Shire Council.
We are seeking a Land and Environment Court ruling that The Hills Shire Council did not comply with the law when they approved the 3 rugby union fields intended to be used by Eastwood District Rugby Union Football Club. It is our case that Council broke the law by not properly assessing the impact on the environment, in particular on the breeding pair of Powerful Owls which are known to call the bushland in Fred Caterson Reserve their home.
Today the Court of Appeal said our expert evidence:
• “helps to give content to the argument and in doing so will provide assistance to the Court hearing the matter”
• None of The Hills Shire Council’s ecological reports “deals specifically with the effect that lighting would have on the powerful owl”
We are grateful for this decision and to our hardworking Barristers who have got us this far. Every step has been a hard fight.
We want the community of The Hills Shire to know that their Council did not once ask the question of how the lighting, including the TV broadcast level lighting, will impact on the Powerful Owls and their chicks.
We are fighting for the best possible outcome for the owls in Fred Caterson Reserve, for the ongoing protection of our bushland and for a Council that is accountable and environmentally responsible.
